Defense files motion to dismiss state case after federal guilty plea but prosecutors say they are prepared to litigate

After Luigi Mangione admitted in Manhattan federal court that he killed UnitedHealthcare CEO Brian Thompson, most experts believe that the state murder case against is highly unlikely to proceed – though some still see a slim possibility that it may yet happen.

Mangione, who pleaded guilty on 14 August to two federal stalking counts, was scheduled for a New York state trial on 8 September for murder and weapons charges in the December 2024 killing. In the wake of Mangione’s surprise plea, legal experts said New York’s state-level double jeopardy law – which means someone cannot be tried twice for the same crime – could derail his local prosecution.

Lawyers seek dismissal of state charges after Mangione pleaded guilty in federal case over Brian Thompson killing

A New York state ⁠judge on Monday ⁠effectively ​postponed Luigi Mangione’s trial on murder and weapons charges over ⁠the 2024 killing of a health insurance company CEO, after Mangione pleaded ⁠guilty last week to separate federal charges.

The ​trial had ‌previously been ‌scheduled to begin on September 8. Mangione ‌has pleaded not guilty to the state charges. Mangione’s lawyers on Friday asked New York state justice Gregory Carro, who is overseeing the state case, ‌to dismiss the charges.

Defense argues New York cannot try Mangione over same act or offense as federal case in killing of Brian Thompson

Luigi Mangione’s plea to federal stalking charges in UnitedHealthcare CEO Brian Thompson’s death has spurred questions about the fate of the separate Manhattan murder case against him, with experts saying New York’s double-jeopardy law could derail that trial.

Mangione pleaded guilty to one count of interstate stalking resulting in death, and one count of cyberstalking through use of interstate facilities resulting in death, in connection with the 4 December 2024 shooting outside a Midtown hotel. Both charges carry a potential maximum life sentence.
